1. Agreement, operator, and eligibility
These Terms are an agreement between you and the individual currently operating the service under the E—BRIN product and operating name. E—BRIN does not represent that a corporation, LLC, or other registered entity is a party to this agreement. By creating an account or using E—BRIN, you agree to these Terms and the linked Privacy and Refund/Cancellation Policies. E—BRIN is available only to people who are at least 18 years old and legally able to enter a contract. This applies to free and paid use; supervision by a parent or guardian does not permit a minor to use the service. You must provide accurate account information and expressly confirm your adult eligibility and these Terms before initiating new AI work or purchases. Existing accounts are not presumed eligible. Account, support, cancellation, privacy requests, and access to existing files remain available for managing or closing an account. The age confirmation is a self-declaration, not documentary proof of age.
2. The service
E—BRIN provides tools for planning, generating, organizing, reviewing, and exporting creative materials. Features may use third-party artificial-intelligence services. Outputs can be incomplete, inaccurate, unavailable, or unsuitable for a particular purpose. You remain responsible for reviewing outputs before publication or commercial use.
3. Accounts and workspaces
You are responsible for your credentials, activity, collaborators, and materials submitted through your workspace. Do not access another workspace, evade usage limits, manipulate credits or entitlements, or interfere with service security. Notify Support promptly if you suspect unauthorized access.
4. Subscriptions and credits
Paid plans are billed monthly at the recurring price shown immediately before Checkout and renew automatically each month until canceled. Plans include the displayed E—BRIN credit entitlement. One-time credit packs add the displayed credits and may require an active subscription. Credits are service units, have no cash value, are not transferable, and are governed by the plan rules disclosed before purchase.
4A. European business availability
E—BRIN's initial European offering is intended for customers acting for business or professional purposes. A European customer purchasing as a business must provide accurate business, billing, location, and VAT information when requested. E—BRIN may restrict Checkout, request additional tax evidence, or suspend European consumer sales until the applicable VAT registration, consumer disclosures, and withdrawal controls are operational. Mandatory rights applicable to a customer cannot be waived by labeling a transaction as business use.
5. Cancellation
You may cancel through the authenticated Stripe Customer Portal accessible from Billing. Unless a different term is conspicuously disclosed before purchase, cancellation takes effect at the end of the current paid billing period and prevents the next renewal. Access continues through that period subject to these Terms. See the Refund & Cancellation Policy.
6. Your content and AI-generated material
You retain rights you already hold in prompts, uploads, brand materials, and other input. You grant E—BRIN a limited license to process that material only as needed to operate, secure, and provide the requested service. Subject to third-party rights and applicable law, E—BRIN does not claim ownership of your generated output. AI output may not qualify for copyright protection without sufficient human authorship, may resemble other material, and may require additional rights clearance.
6A. Optional publication and promotional use
Your content remains private unless you take an affirmative sharing action. When publishing a specific creation, you may separately authorize display in the E—BRIN community gallery, on E—BRIN websites, or in E—BRIN advertising and social media. Those permissions are non-exclusive, royalty-free, limited to the selected creation and destinations, and do not transfer ownership to E—BRIN. You represent that you have the necessary rights and permissions for people, likenesses, music, brands, uploads, and other material included in a published creation. Unpublishing withdraws permission for future uses; it may not recall material already lawfully distributed, cached, printed, or included in a campaign already in circulation, but E—BRIN will stop new uses within a reasonable operational period.
7. Acceptable use
- Do not submit or generate unlawful, deceptive, infringing, abusive, exploitative, or privacy-invasive content.
- Do not impersonate people, create deceptive synthetic media, or use a person’s identity or likeness without appropriate rights.
- Do not upload confidential, regulated, or personal information unless you have authority and the service is appropriate for that data.
- Do not reverse engineer safeguards, automate abusive traffic, resell access without permission, distribute malware, or use outputs to violate law or third-party rights.
8. Intellectual property
E—BRIN software, branding, interfaces, and documentation remain protected by applicable intellectual-property laws. You receive a limited, revocable, non-transferable right to use the service during your authorized access. You represent that you have the rights necessary for submitted materials.
9. Availability, changes, and termination
The service may change, experience interruptions, or discontinue features. E—BRIN may suspend or terminate access for security threats, unlawful conduct, nonpayment, material breach, or risk to the service or other users. Where reasonable, notice and an opportunity to export available materials will be provided.
10. Disclaimers and limitation of liability
To the extent permitted by applicable law, the service is provided “as is” and “as available,” without warranties of uninterrupted availability, uniqueness, accuracy, non-infringement, or fitness for a particular purpose. E—BRIN is not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Where liability cannot be excluded, total liability will not exceed the amount you paid to E—BRIN during the 12 months before the event giving rise to the claim. Nothing here limits rights or liabilities that cannot lawfully be limited.
11. Governing law and disputes
These Terms are governed by Florida law, subject to any mandatory applicable federal law and without regard to conflict-of-law rules. Before filing a lawsuit, you and E—BRIN agree to make a good-faith effort to resolve the dispute informally for at least 30 days after a written notice is submitted through Support. If the dispute is not resolved, proceedings may be brought in the state and federal courts located in Florida, unless applicable law permits or requires another venue. This clause does not require arbitration or waive any right to a jury trial or class proceeding.
11A. Notices and preservation
Legal notices should identify the account, transaction or creation involved and the requested action. E—BRIN may preserve relevant records when reasonably necessary for a dispute, security investigation, fraud prevention, tax obligation, or legal hold. Preservation is limited to the relevant records and does not authorize unrelated use.
12. Changes and contact
Material policy changes will be identified by a new version or effective date. Continued use after notice may constitute acceptance where permitted by law. Questions can be submitted through Support.
